Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of services provided by AAA Coatings, a division of ONITAP Construction, LLC. By requesting a service estimate or engaging our services, you agree to be bound by these Terms.

Service Estimates

Service estimates are provided at no cost and are valid for 30 days from the date issued. Estimates are based on information provided by the customer and site conditions observed during the estimate visit. We reserve the right to revise estimates if significant changes occur to the scope of work or site conditions.

Scope of Work

The scope of work must be clearly defined in writing before services begin. Any changes to the agreed-upon scope of work must be approved in writing by both parties. Additional work beyond the original scope will be billed at our standard rates.

Payment Terms

We require payment as specified in your service agreement. A deposit may be required to schedule work. The remainder is due upon completion of services unless other arrangements have been made in writing.

Payment methods accepted include check, credit card, and electronic transfer. A 2% service fee applies to credit card payments.

Accounts past due by 30 days are subject to collection action. The customer agrees to pay all court costs and collection fees incurred.

Warranty and Liability

We warrant that all work will be performed in a professional and workmanlike manner in accordance with industry standards. However, we do not guarantee specific results or durability beyond our standard warranty period, which is determined by the product used and the service performed.

Our liability is limited to the amount paid for services. We are not responsible for indirect, incidental, or consequential damages, including loss of property or business interruption.

The customer is responsible for protecting surrounding areas and personal property not covered by our work. We recommend removing vehicles, outdoor furniture, and other items from work areas before services begin.

Project Schedule

Dates and timeframes provided are estimates only. We will make reasonable efforts to meet agreed schedules, but delays due to weather, material availability, or other unforeseen circumstances may occur. We will notify you promptly of any significant delays.

Health and Safety

The customer certifies that the property is safe for our personnel to work. If hazardous materials, structural issues, or unsafe conditions are discovered, work will stop immediately. Additional charges may apply if conditions prevent safe completion of agreed work.

Cancellation and Rescheduling

Cancellations made 48 hours or more before the scheduled service date will not incur charges. Cancellations within 48 hours are subject to deposit forfeiture. Rescheduling requests must be made as far in advance as possible.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Las Cruces, New Mexico, in accordance with New Mexico law. Both parties agree to participate in good faith mediation efforts before pursuing arbitration.

Licensing and Insurance

AAA Coatings maintains all required licenses and insurance coverage for work performed in New Mexico. Proof of licensing and insurance is available upon request.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website. Continued use of our services constitutes acceptance of revised Terms.
